Property Maintenance Policy

Courtesy Notification

The Cedar Branch Park Compliance Officer will notify the Property Owner by phone or in person that their property is in violation under the terms of the POA Deed Restrictions. The owner shall be informed, by the compliance officer, that the owner has a reasonable opportunity, but no greater than 30 days, to correct the situation. The owner shall also be informed that in the event the situation is not corrected or in the event of future occurrences, the property owner shall be subject to formal notifications leading to punitive actions including loss of Cedar Branch Park privileges and fines up to $250.00.

1st Notification

The Cedar Branch Park compliance officer will notify the property owner in detail by certified mail that their property is in violation under the terms of the POA Deed Restrictions. The owner shall be informed, via the certified letter, that the owner has 30 days to correct the situation. If the property violation is not corrected within 30 days the property owner is subject to a Fine of $100.00 and loss of Cedar Branch Park privileges, such as access to the boat ramp. The property owner shall have the right under Texas Property Code Section 209.006 to request a hearing before the CBP Board of Directors to contest, dispute or discuss the violation.

2nd Notification

The Cedar Branch Park compliance officer will notify the property owner by a 2nd certified mail that their property in detail is in violation under the terms of the POA Deed Restrictions. The letter will state that this is the 2nd notification and the property owner has been duly notified according to the stipulations under the Texas Property Code Section 209.006. Punitive actions by the board, may include a 2nd Fine up to $250.00, and loss of Cedar Branch Park privileges such as access to the boat ramp. The property owner will also be notified that for each additional 30 days the property remains in violation additional Fines of up to $250.00 per 30 days will continue to be assessed. These fines will be assessed in addition to any other fines which may be assessed by Henderson County. The property owner shall be notified that the POA Board of Directors will consider those punitive actions at the next board meeting.

After 120 Days

After 120 Days a lien may be filed on a property with delinquent fines due.

Dog Policy Courtesy Notification

The Cedar Branch Park compliance officer will notify the dog owner by phone or in person that their dog has been observed to not be on a leash or otherwise restrained under the terms of POA deed restrictions. The Owner shall be informed, by the compliance officer, that the owner has a reasonable opportunity, but no greater than 5 days, to correct the situation. The Owner shall also be informed that in the event that in the event of future occurrences, the dog owner shall be subject to formal notifications leading to punitive actions including loss of Cedar Branch Park privileges and fines up to $250.

1 st Notification

The Cedar Branch Park compliance officer will notify the dog owner by certified mail that their dog has been observed to not be on a leash or otherwise restrained under the terms of POA deed restrictions. The Owner shall be informed, via the letter, that the owner has 15 days to correct the situation. In the event that a second event occurs after that 15 days from receipt of the first notice, the dog owner may be subject to fining in an amount up to $100 and loss of Cedar Branch Park privileges, such as access to the boat ramp. The owner shall be notified that the POA board of directors will consider those punitive actions at the next board meeting. The dog owner shall have the right under Texas Property Code Section 209.006 to request a hearing before the board to contest, dispute or discuss the violation.

2 nd Notification

The Cedar Branch Park compliance officer will notify dog owner by certified mail that their dog has been observed to not be on a leash or otherwise restrained under the terms of POA deed restrictions. The letter will state that this is the “2nd notification and that the owner was duly notified according to the stipulations under the Texas Property Code Section 209.006. Punitive actions by the board, may include fining, up to $250, and/or and loss of Cedar Branch Park privileges such as access to the boat ramp. The owner shall be notified that the POA board of directors will consider those punitive actions at the next board meeting.

Vicious Dog Policy

Under the terms of the Henderson County, Texas, Animal Control Ordinance, the Association will notify and work with the county to ensure the safety of our residents. Residents desiring to report a dog exhibiting hostile tendencies or vicious behavior must call the Henderson County sheriff’s office at (903) 675-5128. The Sheriff’s dispatcher will decide whether to transfer the caller to Animal Control or dispatch a deputy directly. A courtesy call to the Cedar Branch Park Nuisance officer at (972) 489-3220 will allow the Board to keep residents informed. Loose Dog Policy Under the terms of the Henderson Animal Control Ordinance, the Association will notify and work with the county to ensure the safety of our residents. Loose dogs, those that have not been identified as “vicious”, or those that do not have identifiable means of identification, or those animals whose owners do not reside in Cedar Branch Park, shall be reported to the Henderson County sheriff’s office at (903) 675-5128. The Sheriff’s dispatcher will decide whether to transfer the caller to Animal Control or dispatch a deputy. A courtesy call to the Cedar Branch Park Nuisance officer at (972) 489-3220 will allow the Board to keep residents informed.
